Welcome to Stock the Fridge ("the Service"). These Terms and Conditions ("Terms") apply to the use of our grocery delivery service in Summit County, Colorado, which includes but is not limited to the towns of Breckenridge, Frisco, Dillon, and Silverthorne. By using the Service, you agree to be bound by these Terms. Please read them carefully. If you do not agree to these Terms, please do not use the Service.

1. Service Description

Stock the Fridge provides an online platform for customers to order groceries, which are then delivered to the specified location within Summit County, CO as detailed in your Stock The Fridge reservation form.

Reservations to deliver groceries and/or party supplies are placed online at stockthefridgebreck.com. Grocery and supply orders are placed through services like the Instacart app or the grocery store’s website, and we are not involved with Instacart or any grocery store. We strive to fulfill the delivery of all orders accurately reserved and placed in a timely manner and are only able to do this when customers clearly communicate their needs including their grocery order pickup confirmation, vacation rental entry information, and any other details we need to successfully deliver their supplies.

2. Date Reservation

To use the Service, you may be required to schedule a reservation date and pay for the service ahead of supplies being delivered. By reserving a date and time with us, you agree to provide accurate, current, and complete information, and you are responsible for maintaining the confidentiality of your payment information You must notify us immediately of any unauthorized access.

Eligibility: You must be at least 18 years old to use the Service. By reserving and paying for a date, you represent and warrant that you meet these eligibility requirements.

3. Order Placement and Acceptance

All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to errors in product availability, pricing, or suspected fraud.

Minimum Order Requirement: A minimum order amount may apply, and if not met, the order may not be accepted or may be subject to additional fees.

Substitutions: In the event an item is unavailable, the grocery store you are ordering through may offer substitutions. You will have the option to accept or decline substitutions before finalizing the order.

4. Pricing and Payment

All prices are in U.S. dollars and include applicable sales tax. Delivery fees may apply based on your location, order size, and delivery time requested.

Payment Methods: We accept major credit cards and other approved payment methods as indicated at checkout. Payment is processed at the time of order placement.

Pricing Errors: While we strive for accuracy, we cannot guarantee that all product descriptions, images, and prices are free of errors. If a pricing error is discovered, we reserve the right to correct it and will notify you of any changes to your order.

5. Delivery and Pick-Up

Delivery Availability: Deliveries are only available within Summit County, CO. We cannot guarantee delivery times due to traffic, weather, or other unforeseen conditions. Delivery timeframes provided at the time of order are estimates only.

Delivery Location: You must provide accurate delivery information, including address and any specific instructions (e.g., apartment or unit number). Failure to provide accurate delivery information may result in delivery delays, additional fees, or cancellation.

Acceptance of Delivery: It is your responsibility to ensure that someone is available to accept the delivery or that we can enter the premises. If no one is available or we are not provided entry permission and information, we may leave the order at the location specified, subject to your instructions, or attempt redelivery at an additional cost.

Alcohol and Age-Restricted Items: For orders containing alcohol or other age-restricted items, we reserve the right to verify age at the time of delivery. You must be at least 21 years old to purchase alcohol. If age cannot be verified, these items will not be delivered, and a restocking fee may apply.

6. Cancellation and Refunds

Order Cancellation: You may cancel your order up until a specified cut-off time (as indicated in the order confirmation) without any penalty. Orders canceled after this time may incur a cancellation fee.

Refund Policy: Refunds or credits may be provided for items that are damaged, incorrect, or missing. Please contact our customer service team within 24 hours of receiving your order to request a refund or credit. We reserve the right to inspect the item(s) in question before issuing any refund.

7. Product Quality and Expiry

We are not responsible for the freshness or quality of goods selected by your grocery store fulfillment service. Please inspect your items upon delivery. If you have any quality concerns, notify your grocery fulfillment provider.

8. User Conduct

You agree to use the Service for lawful purposes only and in a manner that does not infringe on the rights of others. Any abusive, offensive, or unlawful behavior may result in termination of your access to the Service.

9. Limitation of Liability

To the fullest extent permitted by law, Stock the Fridge and its affiliates, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

10. Indemnity

You agree to indemnify, defend, and hold harmless Stock the Fridge and its employees, agents, and suppliers from any claims, losses, damages, liabilities, costs, or expenses, including reasonable attorneys' fees, arising out of your use of the Service or any violation of these Terms.

11. Privacy

Our Privacy Policy describes how we collect, use, and disclose information obtained through the Service. By using the Service, you consent to our collection and use of your information as outlined in the Privacy Policy.

12. Changes to Terms and Service

We may update these Terms periodically. Continued use of the Service after any such changes constitutes your acceptance of the updated Terms. Please review these Terms regularly to stay informed of any updates.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or your use of the Service shall be resolved exclusively in the courts located in Summit County, Colorado.
